Terms of Service
The agreement between JustOnAir and its business customers.
Effective date: 6 October 2026
These Terms govern use of JustOnAir (the "Service"). JustOnAir is operated by the business named in the Legal Notice ("we", "us"). By creating an account or using the Service, you accept these Terms on behalf of your business ("you"). The Acceptable Use Policy and the Data Processing Agreement form part of these Terms.
1. Eligibility
1.1 The Service is for businesses only. It is not offered to consumers. 1.2 You must be at least 18 years old and authorised to bind the business you represent.
2. Accounts
2.1 We approve accounts at our discretion. We may refuse or close an application without giving reasons, and may request identity or business verification at any time. 2.2 You are responsible for all activity under your account and credentials. Report any compromise to abuse@justonair.com immediately.
3. The Service
3.1 Usage limits are published in our documentation. Use beyond those limits may be refused or ended. 3.2 We may change the Service at any time. We give 30 days' notice of material reductions, except where a change is needed for security, legal compliance or abuse prevention. 3.3 The Service is provided without a service-level agreement unless one is agreed in writing.
4. Payment
4.1 The Service is paid for from prepaid credit at our published rates, unless a written agreement says otherwise. Payments are processed by our merchant of record, Polar Software Inc., under its buyer terms. 4.2 All traffic delivered for your content is billable, whatever its source. 4.3 When credit reaches zero, the Service stops. Stored content may then be deleted, after notice to you. 4.4 Credit is non-refundable and has no cash value, except where these Terms or mandatory law provide otherwise. 4.5 Our usage records are the basis for charges. You must raise any dispute within 30 days of the charge. 4.6 We give 30 days' notice of rate changes. Prices exclude taxes.
5. Your content
5.1 You keep all rights in your content. 5.2 You grant us a non-exclusive, royalty-free licence to host, process, store and deliver your content. The licence covers only what is needed to provide the Service, enforce these Terms and comply with the law. 5.3 You are solely responsible for your content and for your end users. You warrant that you hold all rights and consents needed to broadcast your content. 5.4 The Service is not a backup. Content is deleted according to your retention settings.
6. Acceptable use and moderation
6.1 You must comply with the Acceptable Use Policy. 6.2 We may restrict content or accounts that breach the Acceptable Use Policy or the law. We detect violations using automated tools, human review, third-party notices and orders from authorities. 6.3 Depending on the violation, we may:
- remove or disable content;
- end streams;
- revoke credentials;
- limit, suspend or close your account;
- report the matter to authorities. 6.4 We give a statement of reasons for every restriction, unless the law prevents it. You may contest a decision within 6 months by writing to legal@justonair.com.
7. Data protection
Our Data Processing Agreement governs personal data we process on your behalf. Our Privacy Policy governs personal data we process for our own purposes.
8. Suspension and termination
8.1 You may close your account at any time. 8.2 We may suspend the Service immediately where any of the following applies:
- a breach of these Terms or the Acceptable Use Policy;
- a security risk;
- suspected fraud;
- non-payment;
- a requirement of law or of an authority. 8.3 We may terminate immediately for a serious or repeated breach. In that case, unused credit is forfeited. 8.4 We may terminate without cause on 30 days' notice. In that case, we refund unused purchased credit. 8.5 Your content is deleted within 30 days of termination, unless we are required to keep it.
9. Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.
10. Liability
10.1 Neither party is liable for indirect or consequential loss, or for lost profit, revenue or data. 10.2 Our total liability in any 12-month period is limited to the amounts you paid for the Service in the preceding 12 months. 10.3 Nothing in these Terms limits liability for intent, gross negligence, or anything else that cannot be limited by law.
11. Indemnity
You will indemnify us against claims, fines and costs arising from your content, your end users, or your breach of these Terms or of the law.
12. Sanctions
You confirm that neither you nor your owners are located in, or listed by, a country or person subject to EU, UN, US, UK or Turkish sanctions.
13. Changes
We give 30 days' notice of material changes to these Terms. If you continue to use the Service after a change takes effect, you accept the change.
14. Governing law
These Terms are governed by the laws of the Republic of Türkiye. The CISG is excluded. The courts and enforcement offices of Istanbul (Çağlayan) have exclusive jurisdiction.
15. General
These Terms are the entire agreement between us. You may not assign them without our consent. If any provision is invalid, the rest remain in force. The English version prevails.
